A General View of the Origin and Nature of the Constitution and Government of the United States [1837] - Hardcover
$50.40
by Henry Baldwin (Author)
Baldwin [1780-1844] was an associate justice of the U.S. Supreme Court from 1830 to 1844. A General View interrogates the two schools of Constitutional interpretation that prevailed in his day, strict constructionist and the Marshall school of liberal interpretation. He then presents a synthesis of the two schools that, suggests Bauer, "comes closer to agreement with the states rights interests than with those who favor a national government." It is a view of the Constitution that contrasts strongly with that of Joseph Story. Bauer, Commentaries on the Constitution 243.
